“DESI RIVAAZ” THE HOUSE OF FASHION STYLE PRIVATE LIMITED is a company incorporated and registered under the provisions of the Companies Act, 2013 and having its registered office at H N-4, L N-2 Ext, Udheywala, Jammu. Desi Rivaaz the House of Fashion Style is engaged in the business of facilitating selling, marketing and retailing clothes/garments (“Business”) through the e-commerce web portal. developed and owned by the company and its affiliates (Web Portal collectively referred to as “Platform”). DESI RIVAAZ THE HOUSE OF FASHIONS PRIVATE LIMITED herein after denotes company for the purpose of this policy agreement.
Usage of portal
The Site is only to be used for your personal non-commercial use and information. Your use of the services and features of the Site shall be governed by these Terms and Conditions (hereinafter “Terms of Use”) along with the Privacy Policy, Return and Exchange Policy (together “Policies”) as modified and amended from time to time.

If you believe that any content on the website is illegal, offensive (including but not limited to material that is sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libelous, obscene, pornographic, pedophilic or menacing; ethnically objectionable, disparaging; or is otherwise injurious to third parties; or relates to or promotes money laundering or gambling; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, security or sovereignty of India or friendly relations with foreign States; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, (” Objectionable Content “), please notify us immediately, Desi Rivaaz The House of Fashion Style will make all reasonable endeavors to remove such Objectionable Content complained about within a reasonable time.

Apart from these Terms of Use, the Privacy Policy shall also govern your visit and use of the Site. Any recommendation made to you in the Site during the course of your use of the Site is purely for informational purposes and for your convenience and does not amount to endorsement of the product or services by us or any of our associates in any manner.
PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES PROVIDED OR OFFERED ON THE SITE ARE SUBJECT TO CHANGE WITHOUT PRIOR NOTICE AND AT THE SOLE DISCRETION OF DESI RIVAAZ THE HOUSE OF FASHION STYLE. Company may revise and cease to make available any product/ services at any time. In the event, company is unable to deliver the product to you on time or at all, you will be notified by an e-mail and your order will be automatically cancelled due to unavailability of the product or at your instructions due to failure to deliver the product on the expected time of delivery by our delivery partners. Desi Rivaaz the House of Fashion Style shall not be liable to pay for any damages in such an event owing to cancellation of the order or delay in delivery.

FORCE MAJEURE
Desi Rivaaz the House of Fashion Style will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond reasonable control.
Mode of Payment
Payments for the products available on the Site may be made in the following ways
Payments can be made by Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards. Credit card, Debit Card and Net Banking payment options, Wallets, e-Gift cards are instant payment options and recommended to ensure faster processing of your order.
Shipping & Delivery
We endeavor to dispatch your order within the time as committed on the product page, however due to unforeseen circumstances, the dispatch of your order can take up to [14] business days. You will be intimated via email upon dispatch of the order. Once the order is dispatched, it normally takes [2-5] business days for delivery within India and [7-10] business days for deliveries outside India. Unforeseen circumstances on the logistics provider’s/Seller’s end may cause delays for which Desi Rivaaz the House of Fashion Style shall not be liable.
Customs & Import Duties
You may be subject to import duties that are levied once the package reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, you should contact your local customs office for further information. Additionally, when ordering from our portal, you are considered the importer on record and must comply with all laws and regulations of the country in which you are receiving the merchandise.
Cancellation of fraudulent orders
To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, company reserves the right to cancel pending and future orders without any liability. Company also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website/app/chatbot and stock unavailability. We may also require additional verifications or information before accepting any order. If your order is cancelled after your card has been charged, the said amount will be reversed to your Card Account. Any promotional voucher used for the cancelled orders may not be refunded.
Desi Rivaaz The House of Fashion and its associated acquiring bank or financial institutions reserve the right to recover the cost of goods, collection charges and lawyers’ fees from persons using the Website/app/chatbot fraudulently. Desi Rivaaz The House of Fashion and its associated acquiring banks or financial institutions reserve the right to initiate legal proceedings against such persons for fraudulent use of the Website/app/chatbot and any other unlawful acts or acts or omissions in breach of these terms and conditions

Governing Law
This User Agreement and all the rules and policies contained herein and any of Your usage of Website and Your dealings with Company shall be governed and construed in accordance with the laws of India.
Arbitration
If any dispute arises between You and Company during Your use of the Website or Your dealing with the Company in relation to any activity on the Website, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement and all the rules and policies contained herein, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Company. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language. The place of arbitration shall be Delhi. Your obligations to pay the Payment Fees shall not be suspended during the arbitration proceedings.
Exactness not guaranteed
Company hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user.
Limited License
Desi Rivaaz The House of Fashion Style grants you limited, non-exclusive, non-transferable, non- sublicensable license to access, and make personal and non-commercial use of the Site. All rights not expressly granted to you in these Terms of Use, are reserved and retained by the Site and its affiliates.
Company reserves the right, at any time, without notice, and at its sole discretion, to terminate your license to use the Site and to block and prevent your future access the Site.

Severance
